While we are on the subject of potential suing and what not I wonder if producers realise that performers can turn around and sue you too if they caught an STD on your shoot?

The Health and Safety at work act covers porn too for the simple fact you are still employing someone to do a job.

If it can be proven that they did indeed catch a dose on your shoot that is.

Marino - I don't think the disclaimer is worth the paper it is written on... Under the UCTA 1977 you cannot exclude liability for death or personal injury. I would assume an STI qualifies as personal injury and as such your clause will be disregarded. Furthermore - H&S overarches your contract anyway.

I'm sorry, but this claim is laughable.

You can enforce this for employees. But if the girls are self employed the contract is binding only from company to company.

Thus the girl (as an employee of her own company) is free to work with whoever she likes, when she likes.

An attempt to enforce any kind of contract like this would be a breach of a tax regulation known as IR35

And this is something the taxman would be very interested in as it means both the employer and employee would be liable for additional payments for National Insurance and Income tax (personal would be higher than corporate).

The general feedback on this thread is that your post is ill-informed, nonsensical in legal terms and a huge own goal in pr terms.
I agree with this view.
