The issue is largely why a company legally holding this confidential and sensitive information didn't take greater care of it. If the Data Commissioner finds firm of solicitors involved were lax in their security then they can expect a charge under the data protection regulations.

Have you read up on how they're going about this? They almost never go to court and only around 30% (figures from Crossley himself) actually pay their 'fine'. Of the 70% that don't pay hardly anyone at all gets taken to court. That tells us that 70% are either innocent or ACS:Law know the evidence they have on people just won't stand up in court. If they're innocent then it shows ACS:Law's methods for collecting data and evidence is highly unreliable. If they're guilty, ACS:Law's reluctance to take things further tells me they know the evidence just won't stand up in court (which takes us back to evidence that's unreliable).

And because they seem to be concentrating on suspected porn downloads, and not major movie/music releases, it seems to me they're taking advantage of the fact that many people -innocent or not- don't want their online activities brought up in court where family or friends have a good chance of finding out. I can see how lots of people may just pay up, regardless, rather than having to explain to their wife and kids why daddy has to go to court because he's accused of downloading gay porn.

My take on it all is this isn't about stopping piracy, it's about using fear and embarrassment to garner money.

Why isn't $ky News "first for breaking news"??!?

Noticed that I haven't heard a thing from $ky News, nor can I find one word written about this on their website.

Why would they not want to cover such a story, where thousands of broadband users have had their details released to all and sundry - including bank and credit card details - in one of the biggest alleged Data Protection Act breaches ever? I believed they prided themselves on being "first for breaking news". Is it anything to do with the ISP concerned?....

Would the coverage be so silent were it the bbc broadband ISP involved in all this?
