I think the industry is so fragmented in this country that trying to formalise anything is doomed to failure.
This argument has raged on this forum for years. However for the culprits it's "Business as usual", they don't read or contribute to BGAFD or actually give a toss about this whole topic. Saving money, time and making life convenient for themselves is their only concern.
As far as a database is concerned it is still my belief that such a database could be in breach of the Data Protection Act 1998.
The Act enshrines these obligations :
1/To make a subject access request- an individual is entitled to be supplied with a copy of all personal data held.
2/To require the data controller to ensure that no significant decisions that affect them are based solely upon an automated decision-taking process
3/To prevent processing likely to cause damage or distress
4/To prevent processing for the purposes of direct marketing
5/To take action for compensation if they suffer damage by any contravention of the Act by the data controller
6/To take action to rectify, block, erase or destroy inaccurate data, and
7/To request the Data Protection Commissioner to make an assessment as to whether any provision of the Act has been contravened
It wouldn't be long, bearing in mind how personal this data is, before one of these obligations had been contravened.

The post were it sais that I faked my certs for 4 month, that I agreed in leaving the industy without getting pay etc, etc... its also fake, there are other things and people involved in it that I cant really mention just yet, It was wrong and that why I decided to tell the truth, I was aware about the posibility to get infected and pass it to someone else, it is not the case as my certs are clean as always before, but I was lucky so were the rest.
I didnt exactly got couch out I decided myself to come clean as like i said it was wrong, having me out of the industry wont make you or anyone safer, there are so many performers faking certs for long, long time, an to answer to your question, I would not carry on doing it anyway, as i had the appointment to have them done again before all this happened, I cant tell you my reasson for doing it in the first place in a public forum, and it will not excuse or justify my action, whats wrong its wrong end off, and it was wrong, but I want the chance to rectify it if that is posible.

i go to my nhs clinic in salisbury every two weeks, and it costs me 35 for the cert, and on the same day i collect it i get re tested so this works out to be a good system, only costs 70pm so to my mind even if you only get one shoot a month it pays for your certs, at the end of the day this is our only tools rquired for the job we do, you couldnt advertise yourself as a plumber and turn up at the job with no tools would you, im sure you understand what i mean by this, i personally think there is no excuse for fake certs, sorry thats my opinion, its not just yourself your putting at risk its the others you work with, i'd be ashamed to even think about doing that to myself and other performers

The first think that i said about it, was that im not even trying to excuse or justify myself, only rectify it, and yes you are right, i already said all that, the clinic that i have them done its free, but they do it only ones a month and it takes 2 ful weeks to have them, if i want to have them done twice amonth so i have up to date certs i have to pay 180, and still takes to weeks to pick them up, again just telling you how that clinic works, but im not trying to justify myself, im ashamed of it, that was one of the main ressons for me to be clean in all this.

Theres some of the Uk best producers on here ranting at each other which don't help the problem with unity, so somewhere along the lines you have pissed off each other at some time but get over it, have a drink together, group hug or anything. Once that is sorted all these groups will see eye to eye & might listen to each others valued points.
I also think while i'm having a rave its crazy that Dave Wells can't join the UKAP as he is the most experienced film maker out of all of us as well as a former stud with a wealth of info to give everyone. I will be shot for this message but it had to be said, if everyone called a truce for just one day & sat as responsible adults chatting about issues something will get done.
Being split into little groups only creates bigger gaps so all the chatting on here won't solve a thing.
Terry, Johnny & Jimslip we have watched a lot of your films & like a lot on here look up to you guys & its a shame bad blood blurs your visions, i haven't just singled you guys out as the main reason stopping progress in the industry as everyone is guilty including us.

i dont think its the producers ranting at each other thats the problem Kim. its the performers who are at the heart of this and they should be showing more interest in making it happen.

Jim, the data protection act was covered and worked around the last meeting in December and the clinics had this solution worked out but I guess you wouldnt know since you decided to resign from UKAP without even listening to the clinic reps legal solution to this.
Again , all this is in the interview nicely documented because I knew it woudl come down to this so we are just wasting time defending ourselves and not getting anywhere as Kim said.

Firstly you seem to be suggesting that I'm on some sort of "Rant". I'm not, I'm just making a couple of points. Secondly ss far as I am concerned there is no bad blood between myself and anybody else. Certainly eminating from me. I think my "Crime" has merely having strong opinions about certain subjects. Real relationships, or those of any value, shouldn't only flourish when you always agree with everyone around you.
A good relationship should still be possible between people even when they strongly disagree.
If the House of Commons was made up of pornographers, we'd have all left the building, cos we didn't all agree! LOL
As far as joining UKAP is concerned, I always thought the definition of a "Producer" was someone who invested his own or an investors money in a variety of projects and saw them through to point of sale. Whether it be a website, DVD or TV programme. If you don't do this but generally work for someone else, you are then a lighting man or a cameraman etc......not a producer.
Also when I was a member of UKAP there seemed to be many extremely experienced producers on board including, George from Doll, with dozens of TV and DVD releases, Kenny with loads, myself with over 300 TV shows, people running successful websites like NSS, Terry, Jay k and so on. All of these people are, "Producers" in the real sense of the word.
A good relationship should still be possible between people even when they strongly disagree.

Hi OEJ - as a "producer" of (still) erotic art you know that I don't qualify for UKAP membership.
But I have a number of friends and customers in the industry and I do genuinely care about it.
And, with 30+ years experience looking at legal liability related injury and illness matters across a broad spectrum of industries, I do actually feel qualified to bring something to the party.
There are complex legal issues involved in the subject matter of this thread (tort/negligence, H&S requirements, DPA implications, EL compulsory insurance requirements, etc. etc.). If UKAP feel they might benefit from my experience they only have to ask.
