Because the internet is not subject to Ofcom rules. Also, if you're not uploading content from this country then you are only subject to the rules of the country where you are uploading from. However, many people do upload from the UK. I think they're trying to stifle the internet over here as Ofcom tries to get it regulated.(i think its ofcom, i get confused). Hope that helps, but if i'm wrong then someone let me know.

Unfortunately, you can be charged under the obscene publications act for selling "hard" watersports content as you've described. It doesn't matter whether you do this on DVD or online.
I've also discussed this with the BBFC and it's likely to be overturned at some point... most people agree this guideline (which comes from the police, not the BBFC) is plain stupid. But for the time being, you risk prosecution for publishing or promoting this content, if you are resident in the UK, even if you host overseas.

What i don't get is, Gordy and his butt monkeys are trying to ring money out of everyone, but the single biggest sustainable business in stifled ?
The likely hood of the UK Law actually chasing someone is slim, unless its out and out publicised, or from a massive company.
Its why alot of indie shops get away with murder and the big chains dont.

Technically, the guideline isn't really a "police" one - it's set out in some detail on the Crown Prosecution Service website under the Obscene Publications Act guidelines - and I doubt whether the police are particularly stressed about it in themselves!
But the position is much as has been described - if you are physically located within the UK when you "publish" - ie upload - the material, then if it comes to the attention of the CPS via a relevant police investigation you may be prosecuted.
Of course, it's then up to the jury to find you "not guilty" if they decide the material isn't offensive after all. And, interestingly, in the most relevant precedent - R v Perrin, a few years ago - the jury did in fact acquit on "obscene" material which was "pay for access" and only convicted on similar material which was freely available as a "trailer".. but they did convict, and Perrin went to prison!
So, I agree that it's likely that the "floodgates" will open soon, but I don't have the energy or resources to be the one that opens them!

My understanding of it is that if you are based in the UK , regardless of where the material is uploaded, then you can be prosecuted OR will be in the near future with new BBFC ruling in the pipeline. Nothing to do with "protecting the moral fibre of the nation" of course....The Shylocks(Merchant of Soho Square) just want their pound of flesh....(about ?6 a minute! lol)
