What is allowed to be shown? Well an easy question to answer. Ofcon make the rules and this is what they have to say in the 'Broadcast Code':

1.23 Pay per view services may broadcast up to BBFC 18-rated films or their equivalent, at any time of day provided:

there is a protection system pre 2100 and post 0530 (a mandatory PIN or other equivalent protection), that seeks satisfactorily to restrict access solely to those authorised to view when material other than BBFC U-rated or PG-rated or their equivalents is shown;

1.24 Premium subscription services and pay per view/night services may broadcast ?adult?sex? material between 2200 and 0530 provided that in addition to other protections mentioned above:

there is a mandatory PIN protected encryption system, or other equivalent protection, that seeks satisfactorily to restrict access solely to those authorised to view; and

there are measures in place that ensure that the subscriber is an adult.

1.25 BBFC R18-rated films or their equivalent must not be broadcast.

So there you go if you can't but it in HMV it can't be broadcast.

What I find incredulous is that The Brown Bunny, 9 Songs and Baise Moi have all been broadcast uncut and yet as I pointed out in an earlier post, R-18 equivalent may not be shown.

Cos of the constant chatter about how its so crap that us girls from sport aren't allowed to 'do' anything on air, and that you viewers are not satisfied with what we are allowed to 'do', the only way anything could possibly ever get solved is to simply go direct to ofcom themselves using this handy little link i've added for anyone wishing to speak to them about getting the boundries lifted a little so you can all enjoy the show how you'd like to and we can then stop trying to justify the fact that its not us, its them being all up tight and british!!

Cyprus - my inbox is full of correspondance from Ed Richards, Fran O'Brien and John Glover. I've hit them with every argument possible, TVWD Directive, EHCR Case Law, Kutchinsky, Diamond, D'Amato and so forth.

I've had R18 Freedom of Information Requests denied, appealed and denied again as 'not in the public interest'.

It's never going to change unless the Broadcasters get together and stick two fingers up to Ofcon.

Their 'Code' is not law it has never been laid before Parliament, it is not on the Statute books it is just a guide to Law and thus should comply with law and that means European Law and EHCR Case Law - it doesn't.

Ofcon's interpretation of the TVWF Directive is wrong. All broadcasting must comply with it. Ofcon have created an isolated market in Europe excluding UK Broadcasters from broadcasting domestically what is acceptable in the rest of Europe. This is against the stated objectives of TVWF and thus illegal.

Ofcon does not recommend to the DCMS that other European broadcasters showing R18 equivalent material to UK subscribers should have a proscription order imposed on them under Section 177 of the Broadcasting Act, yet it prevents and actively prohibits any UK broadcaster from showing it. If it causes harm then they would have to issue proscription orders, they don't. The last Broadcaster to be reccomended for proscription is still broadcasting 7 years later as the piece of paper sits on a desk in Whitehall gathering dust, they are to afraid to enforce it. A legal challenge and they are done for.

Ofcon have chosen to ignore EHCR Case Law, it illegal under the terms of Article 10 of the HRA to use a broadcast licensing system to restrict any legally available material as was shown by Groppera AG v Switzerland, 1990. R18 is legally available material.

Ofcon are satisied that thier current stance is correct and legal. It all falls on deaf ears. The broadcasters should be pushing for a Judicial Review. Especially when I can book into a Hilton Hotel and watch full R18 material with just a pin code to input.

I mean wtf? The BBFC is quite happy, apparently, to trust adults to buy R18 DVD and to take responsibility for keeping their contents away from the eyes of children. This despite the fact that they are unencrypted and can be inserted into DVD players at any time of the day or night. But the UK Broadcasters, who only accept orders from adults possessing those credit cards only issued to the over-18s, who confine their broadcasts to the hours after 22.00, and who encrypt their services only to be unlocked by inserting a special PIN number, are limited to only showing shoftcore shite.

I agree with everything you say. As you pointed out earlier, 9 songs, Baise Moi, The Brown Bunny and a host of other explicit films have been shown on various film channels uncut. Is this because the BBFC gave these films an 18 certificate, and therefore they fall within OFCON's guidlines?. If this is the case it would be interesting to see what would happen if an adult producer made a film just hard enough to avoid the R18 classification - would it get shown?. Just what is the status of the BBFC. What terms do they operate under and what basis in law do their judgements have?. I'd be interested to know. As you rightly point out, it really requires a concerted effort by the broadcasters/producers to get this daft situation changed. Acting as individuals we have almost no influence, and yes I did submit my thoughts on this subject during the fiasco of OFCON's bogus consultation process. To make any impact these days you need to act collectively. I've often wondered why no pressure group has been formed to combat the UK censorship laws. The conclusion I've come to is that for most people porn still carries a lot of stigma and embarrassment.
