Hi Kim and John,

The CPS has now added Fisting to it?s Obscene Publications Act and I have received a warning.

We have made the decision to shut down all the sites. We have shut down the public side of them all and currently only members can access the site now but we are winding down their memberships and the sites will be closed down at the end of March.

Charging practice

The particulars of the charge should clearly identify the obscene article e.g. "an Internet website entitled "Welcome" (exhibit reference KDW/6)."

It is impossible to define all types of activity which may be suitable for prosecution. The following is not an exhaustive list but indicates the categories of material most commonly prosecuted:
sexual act with an animal
realistic portrayals of rape
sadomasochistic material which goes beyond trifling and transient infliction of injury
torture with instruments
bondage (especially where gags are used with no apparent means of withdrawing consent)
dismemberment or graphic mutilation
activities involving perversion or degradation (such as drinking urine, urination or vomiting on to the body, or excretion or use of excreta)
fisting


Unless any of the factors listed above are present within the given case, the Crown Prosecution Service will not normally advise proceedings in respect of material portraying the following:
actual consensual sexual intercourse (vaginal or anal)
oral sex
masturbation
mild bondage
simulated intercourse or buggery
fetishes which do not encourage physical abuse.

To the above replies, I will double check but I do believe that this applies to the UK Industry and being filmed in the UK.

I will check with the producer whether or not we will be filming here, and where the footage will be distributed, as I was aware of this law and the filming of it within the UK. I am also unsure at this point whether the footage can be placed online in other countries.

You wont get nicked for it Daisy but the producer making it and distributing it will and to clarify the message in Kims post, fisting has always been high up on the CPS list. Its just that getting cponvictions for it under the obscenity laws are difficult as many juries wont consider it obscene for lack of knowing about its legal position but still, getting raided in itself is a major inconvenience best to be avoided

Completely agree with you OEJ, it's a risk not worth taking in the UK. It's a very fine line with the risk of bondage and the other topics but fisting is fisting and being a producer myself I would not want to mess with the long arm or (short hand) LOL of the law!!!

If fisting is one's bag,there are plenty of foreign websites doing it.VOD, ''Free'' porn etc....
