Hi again everyone,

Following up my previous post titled " warning to models" i have had a personal response via email from the main boss at the channel is question after expressing my actions to sue them for moneys owed.

Dear Michelle,

Further to our conversation this morning, I am now in a position to confirm to you of my decision to instruct Company solicitors, XXXXXXXXX to investigate potential litigation against yourself for slander. The quantum will be based on damages incurred by our business as a result of such slander.

I have also this afternoon asked XXXXXXXX to seek clarification from the Inland Revenue as to your earnings with XXXXXXXX over the last twelve months. This will assist us in our consideration of the above action.

Yours sincerely

Managing Director
XXXXXXXXX

I have obided to the rules of the forum and not named the channel in question or slagged off the channel in question therefore am i correct in saying that the company are not in the position to sue me for slander. All i have done is simply state the facts and that is they owe me money which they are refusing to pay. None of the other details are relevant.

I look forward to them speaking to the Inland Revenue to see that since i have become a self employed model my accounts have been up todate and all moneys earnt accounted for and my tax bill paid on a yearly basis.

If you have not read the other post i got sacked from the channel in question as they wanted Lolly Badcock to work for them but she decided to work on another channel due to her own personal reasons. She was blackmailed to work on their channel but myself and Lolly decided that being blackmailed was NOT an option... therefore they sacked me!

I'm not an expert by any means but it seems to me that they are trying to flex their muscles to try and frighten you off. Just get some sound legal advice and take them all the way. They'll probably back down if and when they realise you're serious. Hope you win out and I'm sure the viewers (if they still have any!) will be missing you loads so it's their loss.

That email is just out of line, and potentially criminal - they may have just made a big, expensive, mistake.

Contact me privately and I'll give you some pointers.

Scare tactics if ever I heard it. They must be seriously rattled to threaten you with court action for speaking about...well whoever you are speaking about.

its true what gdw and welshman has said, its all empty threats that they seem to think you wil buckle under and give up.

If they owe you money then the cheap bastards should pay up with no quibble. It is going to cost them money for legal fees anyway. Best to get it out of the way by paying you what they owe instead of racking up a bill thats going to cost them more for being sheer bloody minded.

Amber, bear in mind:

slander (harmful statement in a transitory form, especially speech) and libel(harmful statement in a fixed medium, especially writing but also a picture, sign, or electronic broadcast)

- just so you know what you are up against.

I don't think they are talking about what is said on this forum, as that would be Libel (written word), I think they talking about something you have Slander (spoken word) so its likely either someone has gone running back to them blabbing (been there before myself), or they havent sought legal advice as a solicitor would never make that mistake.

"I have also this afternoon asked XXXXXXXX to seek clarification from the Inland Revenue as to your earnings with XXXXXXXX over the last twelve months. This will assist us in our consideration of the above action."

Just one other thing - the Inland Revenue won't give out any information about your earnings even if it is a lawyer asking- its illegal as per the Data Protection Act.

They may occasionally lose information but that's a different story.
