Model release

Theoretical situation - someone posts a video they made of a model on a website withoug being in possession of a model release form. What could the model do?

Sue? Prosecute? Or just force the removal of said video from the website?

Well if the model was a willing poser and accepted a fee for the shoot then there is probably not much they can do as this has been aired in court before and the judge decided that as a fee was involved then it was a proffessional shoot and therefore the model should expect the material could be used in any media, also most lawyers would need around ?10,000 up front to even consider taking on a case of this kind, so now you are wondering why do we bother with model releases at all, well they do clarify the matter and we do have to keep records.

Isn't part of the model release process to prove that the model is over 18, (or whatever the legal age is for the country(ies) involved) at the time of the shoot. i.e. they sign that the are over 18 and you get copies of passport / birth cert / driving licence.

Otherwise, unless the model is well established and you can prove when the shoot happened, you could find yourself accused of posting underage material.

I believe tha this is a specific legal requirement in the USA, and has been for a while now, which is why you get the notice about guardian of records at the beginning of porn videos.
