IMPORTANT news from America

Hi All.

This is to all the male and female performers who are thinking about coming over to America any time soon.

There is a bunch of companies who are AT THE MOMENT not shooting european performers due to the new law which is due to take place on the 24th June 2005. (can't shoot the performers who have no american ID'S).

Im sure you have all got wind about this, but if you are thinking of coming over any time soon, then i advise you to call your agents, they can tell you more.

This I believe is to do with the new 2257 regulations, is that correct ? A few of us in the UK who work with partners in the States would like to know if this is what you're talking about. If it is, then it's causing a lot of confusion throught the adult industry not only in the US, but worldwide.

I think the companies you're talking about are worried that due to the models not being US residents, and if they are working without the correct paperwork, could cause the producers problems in the future. This could lead to the models being banned from entering the US again for a few years. If a model has the correct paperwork to work over there, then there isn't a problem, but how many UK models go over there with it ? Is it the H-1B WORK VISA that's needed ? For those webmasters reading this, I was told tonight that being hosted in the States isn't a problem. Hosts are defined as distributors not publishers. They distriibute your pages not publish because they have no editorial decision making.

that is what I had gathered after reading the new law, this part (iv) covers it:

(4) Producer does not include persons whose activities relating to the visual depiction of actual sexually explicit conduct are limited to the following:

(i) Photo or film processing, including digitization of previously existing visual depictions, as part of a commercial enterprise, with no other commercial interest in the sexually explicit material, printing, and video duplicators;


(ii) Mere distribution;

(iii) Any activity, other than those activities identified in
paragraphs (c) (1) and (2) of this section, that does not involve the hiring, contracting for, managing, or otherwise arranging for the participation of the depicted performers;



(iv) A provider of web-hosting services who does not, and
reasonably cannot, manage the sexually explicit content of the computer site or service; or

(v) A provider of an electronic communication service or remote computing service who does not, and reasonably cannot, manage the sexually explicit content of the computer site or service.

No the law actually states hosting companies are exempt.

Also remember that for the 2257 documentation to be correct they have to come and visit your office to check it. Plus have a search warrant with them.

Basically this law has changed three things, record keeping in terms of cross refencing every porn models pictures where ever that are.

Affiliates to paysites will need to keep the models IDs if they are submitting sexually explicit content.

US shooters shooting overseas and shooting overseas models. They can't come here to shoot, get models to there, or Mexico, to shoot. The good news for models is with the need to give out IDs for US companies to give to US affiliates there wil be a drying up of US models.

A hole that will be filled by non US pornographers.

Even though it is a despotic act of backdoor censorship, it looks like there will be some opportunities to sell content to the US as producers may have to reinvent themselves as distributors or give up entirely.

I not sure that's quite correct as UK law says that the appropriate juristiction is where the site is controlled from, not where it's hosted. Usually the only exception to this is if you had a US subsidiary - they would be subject to US law. From what I can recollect there was a recent case in the California Supreme court that confirmed that the same assumption holds true in the US.

The biggest risk in my opinion must be hosts not wanting to test the water in court and so dropping adult business, legitimate or otherwise.
