I'm afraid OEJ, the only place you'd find a lawyer that would take on HM Gov in this matter, would be one in a straight jacket slurping soup through a straw in an institution!lol

The situation is referred to in the USA as, "The tyranny of the 9 year old". This is how it works. Those that wish to either ban or control, "The Media" immediately cite the fact that, "A child may view said material and be disturbed by it!" In the same way, those germs on the Domestos ad were banned because some Chav complained, that her kid's had had nightmares about the ad. Naturally, they were probably allowed to watch all manner of violence on TV and DVD!

Many people have thought of suing the government for various things. For example I thought if you were to gather up all the innocent people stabbed to death on our streets, you might be able to prosecute HM Gov for, "Renaging on its duty to keep it's citizens reasonably safe, when in a public place from acts of violence by strangers" I thinks it's called a "Class action" , ie a case on behalf of alot of people affected by a certain event, like a chemical spill, aircrash, public health etc.

However, in the event of a lawyer acting on behalf of us, good folk of porn, even if you managed to get a preliminary hearing you would be laughed out of court. A judge would declare, "I am astonished that such a case has been brought before me. To suggest that a group of miserable, merchants of filth, should be allowed to sue Her Majesty's Government , for loss of earnings, beggars belief! There they skulk in their Hawaiian shirts, smoking cheap cigars, expecting THIS COURT TO FIND IN FAVOUR OF THEIR DESPICABLE ENDEAVOR! Not only will I NOT give leave for this case to proceed, but I hold this whole group of perverts in contempt of court, bailiffs TAKE THEM BELOW!!"

However as you know, I am in favour of this proposal, i see it as a good thing, when in the history of prohibition whether it be alcohol, literature or porn has it EVER affected sales??

People will violently resist this measure by opting in, for no other reason that they don't want to be controlled by a group nannying wankers and they will opt in whether they look at porn or not.

What the measure will do is get rid of millions of freebie hunters and time wasting kids.

This measure only makes our material MORE desirable!

I doubt people will 'violently resist' this at all.
For most people it is a step to far for a government to block internet usage. Also the 'haven't the government got better things to do' brigade will be making a lot of murmuring under their breath - I think the idea doesn't have legs for the UK unless a private company can make money from it - in which case they will lobby and push for it to happen.

Also in terms of legislation the government is un sueable. If you think about it, imagine if the Coalition introduce a Bankers Tax, the bankers who have enormous resources at their disposal, could sue the government for, "Loss of earnings."

I think we as simple porn folk, can do absolutely nothing, other than observe whether this measure takes hold or not. If we formed a pressure group we'd only make things worse. Even if we had the services of Michael Mansfield QC at our disposal to present our case, that this measure is a gross affront to everyones civil liberties. They would simply reply, "Do you mean you demand the freedom to immerse our children in a sea of filth?" At the end of the day, people can just opt back in, simples!

This will be the outcome, think of a pendulum, if the measure comes in, for a time there will be some resettling for people deciding whether or not to opt in. Very soon, the great mass of people will find that their PC's are being blocked for all sort material NOT just porn. The pendulum will then swing back and order will be restored and all will be forgotten. This is the way of the World.

I meant "violently", metaphorically, I mean they will angrily opt in, for no other reason than they do not want to ally themselves with some braindead computer- illiterate, publicity seeking, nanny.

Sorry to be prattling on, but having thought about it and seeing the way British justice always works, there'll probably be a compromise.

The ISP's will have to write to all their customers, pointing out the hazards of certain material on the internet and offering their customers the option of "Opting out" of receiving this material. There maybe different grades of filter, like 18 + and 18 ? "porno muck".

This idea would keep the Christian nutters happy (Well they couldn't really complain) and the punters happy, everyone wins.

Thanks for your opinion Jim.

You might have missed my point though.

The opt in would be the final nail in the coffin for porn. It wont get rid of the undesirable if the file sharing and torrent sites are left untouched as they are not considered adult at all. People would rather go there and get their porn.

Sure, we'd get rid of the tube sites but I think the filesharing and torrent sites would take over. After all, this is where the kids get it from anyway.

Well, we'll all find out soon enough, but my instinct says, the more we are demonized, the more attractive our product becomes. Look at prohibition in the 1920's, the banning of alcohol caused it to become the basis of an endless party, because it was suddenly, "Naughty". There were more bars set up, AFTER prohibition than existed BEFORE! People have said the same thing (In reverse) would happen if you legalized drugs, to many they would no longer be attractive or desirable.

Porn has become mainstream, disposable rubbish, anyone can find what he or she wants for free. This is a problem for the hardworking folk of porn!

We need Ed Vaisey and his nutters to cast us back into the shadows, make people work to find us, give us some VALUE again!

The people that are happy to pay for their porn, have made that conscious decision to bare their personal info to a website in order to enjoy what they want.

They will have no problem "Opting in" or "Opting out" of having to, "Opt in" to "Opt out!". It will be business as usual for them.

The people who will be screaming, shouting and stamping their feet, are those who want to watch porn for free on computers that have been locked! ie parents, pc's at work, etc etc. Ha! Ha! Ha! is all I have to say to these folks!
