Now that is something I wondered about.

You are quite right Health and safety is paramount in the workplace. !shrug!

You could be in big trouble if a performer injured themselves and you didn't abide by the current legislation.

I am forever filling in permits to work. Writing risk assessments and method statements for the simplest of activities. I get so pissed off with it. !furious!

You can't have a shit without it being risk assessed, so why not having a shag???

Just imagine the back problems caused by not shagging in the correct manner??? Do you train performers to shag in the correct manner? Keep your back straight at all times. !whistle!

Slips and trips from sprayed semen on the floor. Eye injuries from flying spunk. Why didn't you have your safety glasses on? Did you provide the safety glasses? !whistle!

It's a nightmare. I hope all performers have their PPE on at all times???
Hard hats, steel toe cap stilettos, latex gloves, safety goggles and condoms?

It's only a matter of time before someone takes legal action!!shrug!

I was called out to a very large PLC today to do some contracted tech work (this PLC turned over between 15-20,000,000,000 (BILLION) last year so hardly a silly company), anyway I walked around looking for a coffee machine, and wandered into the 'legal' area, and was chatting away about suing them for the coffee being too hot to get a biscuit i dunked out that snapped.

Anyway I mentioned this to them and they laughed, there was a few scenarios where by the producer 'could' be on the wrong end of the law.

1, The name was a mark like 'the rock' is to WWE, you could be forced to change the name.

2, The producer was made aware by the model that she was still within a contract.

-Sup to the above, its not the producers job to run to BB and ask, its down to the model to disclose, if she doesnt disclose this, then its her thats in breach.

They also said a well written release would likely include statements to the effect of 'I understand blah blah not drunk/not insane/no of know reasons why I can't do this/not under any contracts/etc etc' anyway.

3, The 'image, persona and style' was in some way a mark, much like the kiss face paints/leather, and the producer mimic'd this and it could broach something like 'passing off' or something similar.

The aim they said would be one of 2 likely outcomes, (1) costly delays, or (2) run the producer out of money because their pockets are deeper.

I *think* I remembered all of that, but it has been about 14 hours so I may have forgotten bits of it.

Playing devils advocate for a bit here...Is it just a question of asking Blue Bird with eyes fluttering 'pretty-please-with-sugar-on-top' for permission to shoot the girls?

The thing about asking for permission is to expect hearing a "no you bloody well cant"

There are a number of legal grounds.

The first is knowingly procuring a breach of contract [the post-contractual covenants survive the ending of the performance clauses], which is a tort. The producer who commits that civil wrong is liable to BB damages.

Secondly, BB takes an assignment of all rights to the name and image of the girl. So anyone who uses her name or image without our consent is liable directly to us for breach of our I.P. rights. When a person breaches I.P. rights such as these, then the product of that breach is liable to be impounded or destroyed.

So now you know !

I don't suppose the agency paid for boob jobs, cars etc for the I.T. guys, or paid them royalties. So maybe not a good analogy ! But if you know any computer geeks walking around with 32GG's - please share that with all of us ! !happy!
