I wrote an article about this in my professional capacity about 4 years ago; not sure if it's still on the UKAP website though?

PL insurance is optional, but EL is a compulsory insurance class and the potential ramifications of this type of incident could be both criminal and civil.

I agree there Big Al.

However even you have Employers Liability - which every producer should, you are be in breach if you dont follow basic Health & Safety which is to have actors with up to date Certs.

And you are right, failure to do so will could be criminal and civil

But despite a lot of people pertaining to be "professional" I doubt many actually have or understand the necessary Insurance and conduct needed

The whole thing is a joke - so now we know his certs aren't worth shit as he works with un-certed girls .............

How many of the other female models on his AW profile (that he shows having bare sex with) are now coming forward, holding up their hands and saying

"i am taking a 6 month break for the sake of the industry and to be absolutely sure nothing was passed on."

............. none !!!

(and i have looked on there and there are a lot of high-profile and famous models).

Perhaps you should consider the latest podcast on this subject. It might give you a better understanding of why tests are needed. To not have them is madness. Noon ever said a test makes you disease free but it sure helps to identify who are at risk if a quarantine is required.

Surely thats just as important

You're right, although with EL the 1969 regulations mean that insurers must still deal with a claim notwithstanding any breach of H&S requirements by the producer. Where it might then become a problem for the reckless producer is that the insurer would be entitled to seek recovery of their outlay from him/her - potentially putting their livelihood at risk - or even their home, depending on the size of the claim. I've been accused on here of scaremongering in the past, but I firmly believe it will happen one day given the wide ranging nature of the UK industry and the way many "producers" go about their business. Of course, it's more likely that when that case arises the producer won't actually have any EL insurance - which of couse would only be an aside, as not having insurance wouldn't bar the injured party from bringing a civil action.

Until people realise that this is happening more times than just when it is reported and use condoms there is no way forward as people will always lie.

After all it is human nature to do so. Especially for gain.

Am not saying that performers should test to find out if they have something. It's just that the impression that comes across at the start of this thread is that if both performers had the new model Ella wouldn't have to worry about the outcome of her upcoming test if she had shot with Monty just because both of them have clear certs.
It's possible she could have been the 20th girl Monty had shot with on that cert and unbeknown Monty could have picked something up from any of the other models or the girl could have got a false negative from her test putting Monty at risk. Certs will never tell us this.

As long as diseases exist they will always be risks involved and a quarantine would only work quickly and effectively if there was a central database which listed ALL performers shoots/content shares and who they have worked with.

Us & other people in the industry have had to pay higher polices than the average Joe public because we are in the adult industry, when insurance companies can be bought into line with the American insurance companies many more UK producers will get liability insurance.

Insurance companies like the Government take the piss with our industry trying to claw every penny they can from us, because of the problems we have had we tell everyone not to say anything on their insurance polices as they will go up in price & like us find it hard to get things like home or car insurance.

No one as ever addressed this problem & until we are guaranteed our polices won't be affected in writing by the insurance ombudsman there be very few people getting liability polices...
