Re: Now theres a thread!

I really do not understand why so many of you are getting in a fluster about such a blatantly idiotic post.

Its obviously either a joke or an A Level law student whos had one too many shandies. It hardly even warrants a reply which is why I didnt bother replying but I must admit I did chuckle when I read it. When will people realise that these stupid US laws are not enforcable on the rest of the world unless they grab us and take us to Camp X-Ray in Cuba where no law applies and the Geneva Convention is ignored. The USA make up laws as they go along to suit their purposes. A good example is holding people indefinately at camp X-Ray in Cuba with no access to lawyers or a telephone. Then when they get bored they boot them out as they did with the Pakistani farmer whos wife thought he had been eaten by wolves until he turned up 6 months later saying he got carted off to Camp X-Ray by Dubyas sinister bunch.

I have worked in the legal game for years. I did it the hard way. Studying for my qualifications while earning sixty quid a week as a solicitors clerk. Even as a fully qualified Legal Executive (which is far higher a qualification than a law degree from some poxy ex poly) I still find these young graduates who come to our firm to be ill educated twats who watched too much LA Law when at school. I earn less than a policeman or even a shelfstacker in ASDA despite the fact that my work brings in ?100 per hour I get paid less than ?6 per hour. And I get better results on cases than the partners in the firm never mind these clueless wet behind the ears graduate cunts. Thats because I am brighter than these newly qualified solicitors. Any halfwit can get onto a law degree these days as you will have seen on tv that a levels are getting easier. They dont have the people skills these new twats. Clients like me because I am one of them ie no stranger to the inside of a police cell and they realise I know what I am talking about. I dont bullshit them with crap university bollocks. I tell them the truth eg if they are guilty "plead guilty mate or your fucked. Its Judge Twat today and he will pot you for five as soon as look at you". If they are not guilty then its a whole different ball game. Anyway its mostly PI accident claims and divorces now not crime.

Anyway I am fucking off to work in the public sector soon at my local Council where I will be paid properly for defending all these trumped up accident claims. So much for Dibbles Thatcherite ideals. Private sector? Shove it up your arse. I only stayed where I am on low pay out of loyalty to my employer who helped me when I was starting out. But he accepts that I am underpaid and wishes he could pay me more.

Sorry for this off topic rant. I didnt realise I was doing it until it was typed

Whos going to enforce it? You can send out notices threatening fines but who is going to force the guilty party to pay??? And if they dont pay what then???

Rubbish.

"You are so wrong about DMCA being just American !!"

The DCMA is NOT enforceable worldwide. It is enforceable ONLY against US citizens, persons residing in the US, or companies with assets held in the US.

As a similar offence doesn't exist in UK law you can't be extradited for it either. The only reason you get any response is because either the individiual is based in the US or more often than not their host is.

The UK law on the matter is primarily civil based on the Berne Convention.

Anybody who thinks unilateral US legislation has any bearing on the UK has been listening to Donald Rumsfeld for too long!

Firstly Magoo, I was sorry to hear of your poverty! I have this very afternoon, despatched 3 x hercules transport planes from Barton Aerodrome, carrying baked beans, sausages, jaffa cakes, custard, and pork pies,-oh, ans some veg, you need that, secondly this thread is crap, how/why could you enforce that DMCA law, if you nab a picture of a american hosted site and put iy on yer own, firstly someone has to spot it, then notify the owner, assuming you can find them, remembering it,s porn related, then get a lawer who,s prep.......oh I dont even know why I,m typing this, sometimes it gets too deep on here, it,s just pictures of girls for christ sake, not fuckin Beckham.
BTW, Maggs, good luck with your new job, I dont think youll need it though.
anyone would be proud to have you on board, why I,d take you on myself, but were a bit slack at the moment...er quiet..moving premises, er...low on orders, you know how it is.......cuppa?

Did you know that 99.99% of adult sites are hosted in the States? This is because UK hosts just about allow topless images though I know of a legitimate model agency that had to move hosts to the States as their UK one wouldn't even let them have topless images.

Have you ever read the terms for being hosted ? They do not allow the publication of copyright material without permission. If the host refuses to take action, then their upstream provider can take action against them and close them down.

I have been successful with every DMCA action against US and UK webmasters, just by sending a fax and an email so please listen to someone who knows what he's talking about. Where you come up with the extradition part of your post I'll never know as that doesn't even come in to the equation.

Just read my copy DMCA and learn, instead of spouting off a load of rubbish.

Not rubbish MrC, mere facts, were not talking professional sites hosted by bla bla bla, just people nicking pictures off sites, you have a pay site with samples, I visit it and nick a few piccy,s and I put them? so another person comes along to my site, and nicks them and puts them ? and so it goes on, in short, your psuedo legal document aint worth nowt!. I have a site with a few of your pictures on right now! I got them from another site.

Sorry C, but the story,s still the same, it,s a almost impossible task to police, especially where news-groups are concerned.I once e.mail a model who I know to tell her that her pictures were on a well know USA model site, her responce was to laugh, and she said she felt flattered.

I agree entirely with you entirely, the prospect of being fined $100K in a US court only frightens errrmmm let me see, US citizens.

You know what I mean? if you have a professional site, with a cc, facility, a disclaimer, a visible site host, a membership section, maybe youll get told off for stealing content, but if you have a completely amatuer site that changes severs, hosts, content, description, even name! every other week, what chance does someone have of sueing you? sorry for the mix up! Joe A,s correct of course in theory, but in practice, simply impossible.
