'...ATVOD has a concessionary rate for "non-commercial" video on demand...'

That's big of them.

And if it's not a tax on freedom of expression, I dont know what is. Not to mention, since we are not dealing with libel or threats to the person, a curtailment of that freedom.

If anyone from the UK wants to upload hardcore porn videos/still photos that they have created for free to the internet, why not do a 'Philip Green' (see here) and get some friendly relative/friend living abroad to be the 'owner/service provider'?

Or, if not uploading to a single, dedicated website, why not utilise those dreaded tube sites, Youporn, Xhamster, Pornhub, etc?

I imagine that Johnson's little helpers (including the sneak who was the instigator of Insculpt's woes) would be on the look out for any UK based uploader who had a channel or marked presence on such sites. As the tubes dont have what atvod consider a proper gateway they would be on to you pretty quickly. Were I to be in a position to shoot and upload material, it would be to promote my availability as a cameraman/director so I would want people to know it was me, hence I would be easily identifiable.

I'd still like to know what if anything we can do about the ATVOD, is there a way to take a stand legally without falling foul?

The answer to that is, YES

But it cant be discussed openly on a forum. In fact it wont be discussed at all while it is pending...except maybe in a pub over drinks but even then...

There is a case going on right now if anyone wants to use Myles Jackmans services

RGB, I understand you are a decent law abiding citizen and that's preciseley what ATVOD want you to be. Blind. Unquestioning. Compliant.

For what?

Its like taking my car to a garage to be fixed then paying for a bill of service to drive my car away and find theyve done fuck all but take my money.

Im not against protecting minors but im not happy at having the wool pulled over my eyes about it. Reguesting a bunch of sites is not the answer. Thats just spin they use in the media to justify their service is working and decent law abiding citizens like yourself are making that happen without question

This is a massive point!, how would someone in any line of video/media production promote themselves? ignoring the adult aspect. If I was a wedding camera man and want to put an example video on my site, would I still have to pay the ATVOD? A website used to be a cheap and accessible way of advertising ones talents. adding ?140 per year to the hosting costs probably rubs out any revenue the site brings in.

Getting drunk while fighting the ATVOD at the same time? sounds like my kind of activism =)

I don't think that would come under ATVOD. You have to be delivering television-like programs on a video on demand service to be caught by ATVOD rules - or porn, in which case they will twist the rules to catch you whatever happens!
Just showing videos incidentally as part of your business doesn't fall in their ambit - as ATVOD discovered when they took on the newspaper websites.

hmmm,

so....

as I am in fact a budding camera man, trying to gain employment in the industry in very much the same way a wedding photographer would.

And I consider each upload as an "example show-reel" instead of a movie or program, do you think I would be safe from their claws?
