Its pretty simple I think - if its al fresco its a public place by the definition of the law. One of the more stupid acts of a particularly stupid government...

the question is
'how would the bbfc know or not know that somewhere was privately owned'

you can go to the Land registry and get some info about the land I suppose

If making it illegal is supposed to stop it from happening, the government should consider why people would want to try it outside in the first place; it's naughty and you might get caught. And now, they've added the ectra thrill of it being illegal! Now everyone will want to try it!

Could the government make it illegal to pass stupid laws?

In Texas, for example, it's illegal for a woman to take a cow onto a bus.

On a lighter note Bill,
I was once pulled in Maine for carrying my drink from the bar to a table!
There are many many statutes on the books of the "civilised" Western World, just as there are in other parts of the globe.
None of them make sense in reality, but THEY can still nick you for them, with various amazing penalties, including Death. Depends on which country/culture - all cause we like sex!!
On the other hand, war and terrorism for whatever cause is OK

If you supply paper work in the form of a letter with consent from the person that owned the property stating you had permission and that certain steps were taken to avoid members of the public seeing an overt act of sexual exhibition you'll find theres a good chance it will get through.

The reason why most public places stuff doesn't get through is because most people can't supply this form of paperwork with model releases and i.d's so that if need be they can cross reference you if the need arises.

However, if you shot something in public in another country, it's okay...If you don't get caught that is. Cue thunder and lightning and lots of maniacal laughter.

Actually, yes: Seventeen has featured them (although hardly as an integral part of the plot.......).
And clogs, and those weird little head-dresses that are part of 'traditional' Dutch folk-costume.
Occasionally I watch the sex, as well........
