Bring this thread back to whats it about...
I had no clue girls weren't allowed to shoot for others afterwards, but it makes sense...
Bluebird put alot of time and effort into looking after there contract girls, and i think its only fair, at the end of the day the girls were happy to take the contract while it was in front of them
Any way back to off the topic, hope you your all well at bluebird head quarters...
Give my best to the team, along with Paul Carder and the guys at Relish....Bluebird really take care of their performers....

Why would the producer be in breach? Surely it would be the model who is in breach of contract provided the restraint of trade contract stands up in a UK court of law.
To be a fair and just contract, the model must also have rights such as the ability to quit the contract and continue his / her career.
In IT in the 90s, contractors use to have unenforceable contract sections which included restrain of trade so that you could not work on a client for six months if you had been booked via an agency. These were never enforceable under UK law.
At the end of the day, if the employee is happy with your rates & treatment, they will stay but if not, they have the right to leave. Otherwise, it's slavery.

The models are self employed, not employees.
The law has always allowed for reasonable enforceable non compete clauses re business dealings.
I myself signed a 2 year one after selling a business, which was fine because it was tightly defined, preventing direct competition but nothing else.

I must admit I would try and find out if a model was contacted or not before I shot her or was even thinking about getting intouch, however stupid of me or not I would not think twice if a model asked me for work or I contacted them and they said they were no longer contracted, I probably wouldnt even think of looking it up before this post was made and I'd of taken the girls word for it.
So whether some people think these contracts are legally binding or not in terms of the trouble we can get in as a producer, I wouldnt like to find out.
I must admit I dont fancy ringing other companies up to check or ask permission either and that's one thing that I have never liked, that you can't book who you want because someone is contracted as it should be fair game. I know its not personal and its just business but still, if you cant compete in terms of a hugh budget then it does put the dampers on your plans sometimes.
Hence why I think when the smaller producers if they find a new girl that others are interested in but is selling well on there site, they dont like sharing the girls contact details incase they get signed up and then you cant shoot them at all. Maybe wrong to hold back but I guess you can see there point alittle.

I dont understand why any girl would sign a contract unless they are being paid an absolute fortune, Why limit your career? It smacks of "we're so big we can do what we like syndrome"
All this talk of being taken to court for using a girl who is under contract is laughable.

hmm if the list is out of date then has the producer got any come back if he says I didnt know she was under contract as the list didnt say so?
If there isnt up to date one then would that not cancel out the legal issue on BB's part?
I think you would get alot of producers shooting girls that are under contract if they dont have the most up to date information, but I dont know I havent checked the list. Just going off what people are saying in this thread.
I have never seen the point on contracting models neither like Asylum, I mean if you have the budget that BB have you can just get them back anytime you like right?
Plus we all have something in common with each others work, we all shoot models who appear on each others sites too, its always going to happen if you shoot someone who is popular or well known, so contracting them to shoot only for you I dont think isnt solving anything as the average porn viewer probably isnt bothered if its a hight end scene or a typcial british pov/Gonzo scene, if it has a girl featured who they want to see then they will buy it if they want to part with their money.
Then again you get fans of a certain model and they will join and download every scene and every site they appear on,so I guess there is too ways to look at it.

What Bluebird are trying to do is use their US business model and apply it to the British Market.
Sometimes, the US and UK model can work and sometimes they don't - take a look at the likes of McDonald's and Holiday Inn as a successful illustration.
However, there is one crucial difference between the UK and US with regard to the porn industry and that is the amount of work a model can get during her period in the industry.
In the US, there are lots of opportunities to work with numerous different producers and companies but in the UK, we have a substantially lower number. As a result, a girl may need to be making films with a number of people at the same time in order to maximise her talents over the future years.
Given this is only B/G work, some models might be happy with this arrangement or it suits their requirements such as shoots with their partner only.
Others might not be happy with this arrangement so shouldn't become a contracted model.
It does though beg the question can models contracted to Bluebird do amateur non-published shoots, 'extra' work which compliments their modelling status as well as magazine and other internet work up to g/g?
It will be interesting to see how this works but given I've just seen a lovely picture of the Lee Twins performing, I hope it does ok.
After all, I think another well known website uses similar tactics but doesn't but the model under contract; just says they won't use them again for a while if they shoot b/g elsewhere..
