How do they go about getting them taken down then ? Is it to do with the fact it's published without the persons consent ? . JJ . There was a case a coupe of years ago , albeit it was used in an ad' campaign but they got compo' for photo taken without their knowledge and published without consent .

That would be because the person would be seen to be endorsing the product, which is an entirely different legal problem.

Its the wording associated with such pictures that can lead to problems and pictures beong taken down.

A picture of you walking down the street, no problem.

A picture of you walking down the street, captioned "drug dealer patrols his patch" you'd have legal recourse then.

A pic of David Beckham with a can of coke in his hand in a newspaper, no problem.

Very True. We've ordered a copy of the DVD incase once we contact him, it mysteriously vanishes and we want to take it further but have no evidence of there even being a dvd.

We will be seeking to have him take it down, and if it turns out he is breaking the law by using this footage then we will be taking it further to make sure he won't be doing the same to all the other girls in his DVDs.

I know this area is a bit of a minefield and hard to prove anything and the law nearly always seems to favour the bad guy!

That said it seems really wrong that someone could be allowed to film girls in school uniforms having fun on a night out where they think it is relatively private and won't go further than that club. Then without asking their permission sell the footage as adult DVDs and make a profit from it.

I'll post an update here and tell your guys how far we get with it, and hey keep an eye out in the papers too!

Something else you can try is contacting his web host if all else fails - tell the web host that the guy is using images of you without your consent. Again the web host may get shit scared that they will get dragged into a legal dispute and be held partially accountable and might either get him to remove your content or even shut him down completely but this should really only be a last resort and only done once you are able to show the web host you have exhausted all other reasonable avenues.

If you havn't signed a consent form he has no right to use your likeness in a commercial production.
