Need help with the ATVOD rules

Hi Guys,

I know it has been ages since I have been on here as I have been waiting to see what happens with the new rules with the ATVOD

Well long story short they have found my small website and after a number of emails over the last couple of months and having them go in and look at my site they have informed me of how much I have to pay a year to keep the site online

Now the cost is not as much as I though so am happy ( well not happy ) to pay it but they are all so saying that because it is a hardcore site I have to make sure that all the people who view and sign up to the site must be 18 or over

I have told them that there is a disclaimer on the main page but according to them that is not good enough,

They are saying I would have to take down ALL hardcore photos and video which of course is not a option

according to the rules and regs they are saying I must have one of these in place on my site

Technical tools which may be acceptable for age verification purposes include:

Confirmation of credit card ownership or other form of payment where mandatory proof that the holder is 18 or over is required prior to issue.

A reputable personal digital identity management service which uses checks on an independent and reliable database, such as the electoral roll

Other comparable proof of account ownership which effectively verifies age.

Now not being silly but I have never even hear of this stuff so how the hell am i to put it on my site? plus I have never seen anything like it on other site

Hi,

Yep, crazy rules.

1) Credit Cards - if a credit card is the only way to access your site then that should do.

So long as the previews etc are all soft.

But yes, all those nifty payment systems like phone and internet money and whatnot, toast.

2) Ageverify.net - nope.

"forcing them to enter their birthdate" - er, what about if they tell a fib?

Apologies for going off on a tangent, and not answering the questions of the OP, but where does a site like rampant.tv or sexstationtv.com fit in with the ATVOD rules, i.e. a hardcore porn site that doesn't require payment to see much of its content?

Well sexstation ukash now seesm to require a CC, but the mobile option works, which is interesting as last time I spoke to ATVOD they didn't consider any mobile systems a secure enough system to prevent under 18 access.

maybe they have changed their view, or someone is gunning for a legal fight.

While Sexstation IS a 'UK' site, with 'UK' content, it is owned / run / uploaded to by a company in the Netherlands.

Isn't there a rule that if the source of the material is the UK, which I presume it is for that channel, then it comes under ATVOD irrespective of where it is uploaded to?

No, its the uploading / editorial control that is the factor...

ie. I pay you to shoot for me, in the UK - I live in Amsterdam. You shoot my content for me - Send it to me on DVD.

I edit, and upload it. - Simple as...

didn't look into who owned it, but yes, if editorial control resides outside uk, ATVOD have no jurisdiction

basically the effect of ATVOD will be to ensure that all UK porn is controlled from overseas

not they care, they are, in their opinion, just implementing the law as laid down by parliment.

I believe it's no longer viable trying legally to run an adult video site where "editorial responsibility" lies in the UK.
