Whats the Law
Re: Whats the Law
That's quite right, the deprave and corrupt part goes all the way back to 1857 (?) when the Act was first drafted. Aside from the d @ c definition being impossible to prove in Law the Act has mainly suffered from poor drafting. The problem is that 'deprave & corrupt' is a Jury point and there's no predicting the outcome, still a lot of little Englanders out there in Juries.
Re: Whats the Law
.....hence Plods reluctance to charge using the OPA. Its the "deprave and corrupt" bit that makes the charge unworkable. And while we are on the subject lets remember that the terms "indecent" and "obscene" have very different legal meanings.
Re: Whats the Law
That's right. But they can still charge you with it and if the Jury are a bit prudish then you've had it verdict-wise.
Re: Whats the Law
So really our friends need to do their homework on the past doings of the Nottinghamshire Vice Squad?
Re: Whats the Law
Indeed, and with regards what might be called 'mainstream' porn not guilties under the OPA were common, if not the norm' from the mid - 70's from what I've read. Didn't stop them just seizing again & again 'till they found the 'right' jury to get a conviction.
With regard the VRA, the thing still stands, yet it's tennants are almost completely ignored even by the BBFC. Simply demonstrates the deep history of utter hippocrasy and political cowardice when ever the issue of sexual censorship is raised in the UK!
Rant over, time to lie down!
