Repudiation, Termination, Courts and Royalities
Gets very messy since the courts don't like to see a "guilty" party coming out ahead.
The court would probably invoke something by Denning and cut to the chase of "what was this really all about?".
You'd probably end up losing the clause, losing the advance, but keeping future royalties.
So, if those royalties are likely to be good, the CG would be irrational to rock the boat. But if you have loaded up a huge advance against a tiny percentage, serve you right
I still think you'd be happy to negotiate with any girl not wanting to directly competitive work for a major competitor, even if you don't want to admit it. Commercial contract lawyers and courts cost too much for rational businesses to want to play with for anything but the biggest issues.

The exclusivity of Clause 5 does not say anywhere about what context 'The Performer' is appearing.
If 'A Performer' decided to be an audience member, why should the television company or ticket distributor have to check with anyone else if they want to attend?
As for a concert not being "a performance", a concert is a performance by the artist on stage therefore
And given a number of BB CG are available for non-modelling activities from 'agencies', should punters hiring them check with Bluebird whether they can see them?
I really hope someone takes on BB as I really dislike big bullies and their tactics in trying to scare the smaller producers.
Also, I hope the models read this thread and decide carefully whether they :-
a) want to out of work for a year
b) want a boob job
c) are happy to be handled by a company who seem to be actively looking for a fight in the UK.
And having looked at the CG list, only two seen to have very little content outside of BB so most will probably retire when their contracts end.
