Not something I would normally promote, but this is such a blatant mis-carriage of justice that I felt it worth mentioning on here.

I was in total agreement with the majority about a miscarriage of justice,just about to sign the petition then came across this info..

The problem with Courts Martials is that the outcome can never be predicted. Also, sentences are disproportionate to the crime when compared to a civillian court.
A good brief can get whole procedures overturned if there is the slightest breach of procedure. In 1972 a soldier in my Regt who was guilty as hell and up for a GCM engaged a civvy lawyer to get him as low a sentance as possible. The brief read everything he could about Courts Martials and when the day arrived he allowed the prosecution to procede and then stood up and declared that the Court was not legally constituted and should be dismissed. The reason? There was no Union Flag flying outside the Court building to denote that there was a GCM in session. This being a procedural legal requirement in the Army Act and Queens Regulations. Therefore the Court President declared that the prisoner was dismissed. That brief earned his fee, but the squaddie was later dismissed on other grounds, but, he didn't end up in the slammer. His crime? He misappropriated thousands of litres of duty free fuel coupons, tobacco and spirit coupons and sold the lot to German civvies. He bought a brand new car for cash out of his "earnings"
What sticks in ones throat with Sgt Nightingales situation is the numbers of bad bad fuckers who get a slap on the wrist and told "Don't do it again"
Now the top Lawyer in the land has declared that he won't stick his oar in and that Sgt Nightingale should appeal the sentance in due course.

Maybe I am missing something here, but it is worth pointing out that if I or you, Andy had had a Glock pistol and hundreds of rounds of live ammunition under the bed in an unsecure location we would be looking at 5 years minimum in a UK jail.

My understanding is that Danny Nightingale has:

1. Not received a prison sentence. It is a 18 month period of "military corrective training" in which he will in weeks to come be able to go out for days at a time etc.

2. He has not been sacked from the army.

3. And it must have been drummed into him just as it is to every other soldier that keeping a fully working pistol and hundreds of live rounds in his personal accommodation where anyone could wander in and help themselves is a complete no-no.
