Was a load of bollocks. Terry's lawyers stupidly argued this but what was obvious to all was that the FA were not charging Terry with racist abuse, they were charging him with using racism language, which he'd already admitted to in court.
The FA didn't have to consider the context of what was said to bring charges, like the law did. The words spoken were enough.
