Ofcon have clearly defined duties under law.


Ofcom's Statutory Duties
Under the Communications Act 2003:

" 3(1) It shall be the principal duty of Ofcom, in carrying out their functions;
(a) to further the interests of citizens in relation to communications matters; and
(b) to further the interests of consumers in relevant markets, where appropriate by promoting competition"
Ofcom's specific duties fall into six areas:

1. Ensuring the optimal use of the electro-magnetic spectrum
2. Ensuring that a wide range of electronic communications services - including high speed data services - is available throughout the UK
3. Ensuring a wide range of TV and radio services of high quality and wide appeal
4. Maintaining plurality in the provision of broadcasting
5. Applying adequate protection for audiences against offensive or harmful material
6. Applying adequate protection for audiences against unfairness or the infringement of privacy


Ofcom's Regulatory Principles

* Ofcom will regulate with a clearly articulated and publicly reviewed annual plan, with stated policy objectives.
* Ofcom will intervene where there is a specific statutory duty to work towards a public policy goal which markets alone cannot achieve.
* Ofcom will operate with a bias against intervention, but with a willingness to intervene firmly, promptly and effectively where required.
* Ofcom will strive to ensure its interventions will be evidence-based, proportionate, consistent, accountable and transparent in both deliberation and outcome.
* Ofcom will always seek the least intrusive regulatory mechanisms to achieve its policy objectives.
* Ofcom will research markets constantly and will aim to remain at the forefront of technological understanding.
* Ofcom will consult widely with all relevant stakeholders and assess the impact of regulatory action before imposing regulation upon a market.

Channel 4 show erect cocks and close ups of pussies but dress it up as ""EDUCATION"" bollocks...therefore allowed to get away with it. Whereas porn behind a pin number is kept softer than butter.something is wrong somewhere.

Some channels also have a huge stock of hardcore originals that they cut down into softcore.

JamesW: fair point, which I've noted. Thanks.

However, I think that my original point still stands - if it ain't broke for them, they ain't going to rush to fix it. And certainly not in this particular situation.

Yes, your original point is still valid. The way they work now is clearly a viable business model, so challenging the rules isn't a priority.

Of course it makes sense. Documentaries and sex education films are not produced for the sole purpose of arousing the viewers; porn films are. Therefore when you watch the former you're not supposed to get an erection, it's against the rules. (I did when I watched The Lovers Guide, but don't tell the Authorities).

No, it wasn't really shown on television, and please don't anyone think it ever has been.
This is taken from the TVX website, which shows R18 versions of the softcore shite that is broadcast on TV. You may be surprised to hear that entry to the website is not free.
Well, I never, whatever next - and we wonder why the satellite channels never challenge the Ofcon Code, and lose all that revenue from satellite, and more revenue from their website. Pity there are so many mug punters out there who subscribe to the 9xx channels, thus making it commercially viable for the broadcasters to get away with it.
