Her work, getting on that way, yep. I think copyright protection is 70 years now, rather than 50, after the author dies for literary works. And google tells me she died in 1848.

But as Autolycus posted, names come under trademark rather than copyright law. I know the estate of Jimi Hendrix, for example, won a case to get back rights to the domain name Jimi Hendrix from someone who took it, and Jim's been pushing up daisies quite a while. Admittedly, not as long as Emily Bronte. But I've no idea how long someone's name can be trademarked, or under what circumstances the trademarking applies.

Luckily I have the privilege of knowing Emily but would also like to find more photos/videos of her. Just look at her - an absolute stunner. Well pretty and she has, as said here, a fantastic rack for a slim girl.
