Its strange how the levell assumption that the buisness being opperated is done so outside the law is fine but repeatidly pointing out that it may not be is not?

You know Digi-Dude; you're so much more attractive when you adopt a reasonable, rational, and coherent tone.

However, I still maintain that, technically, Jay is trading illegally, regardless of what he might have said (though I don't recall him saying that). And if he has obtained a merchant account from a High St bank, he will not have conveyed to them the true nature of his business.

There was a recent court case concerning at least three large British adult supplies companies and DVD distributors who were caught doing precisely what Jay is doing now. Though they deployed some fancy lawyers and put up a spirited defense, they still got found guilty and were handed down hefty fines - and in one case ordered to pay court costs of ?22,000! Here are the details on Melon Farmers -


"Interfact, based in Barking, was convicted of breaching the 1984 Act by District Judge Curtis at Liverpool magistrates court in April 2004. The company was fined ?3,000 for supplying four R18 videos ? Club Reps, Riviera, Bikers? Gang Bang and Cathula. It was also fined ?2,000 for ?offering to supply? 44 films in its catalogue.

Pabo Ltd, a mail order and catalogue shopping company based in Roman Way, Coleshill, Birmingham, was found guilty of similar offences at the same court on April 7 by District Judge Morris. The judge fined the company ?2,500 and ordered it to pay ?22,314 prosecution costs for supplying four videos ? Shameless Desire, Shane?s World, Titano and Top Marks for Effort ? and offering to supply 53 films in its catalogue. Pabo is also challenging the ?grossly disproportionate? costs order."



Hey, don't get me wrong, I don't have a problem with certain types of illegality (God knows, I'm no stranger to police cells and courtrooms) But what you are saying seems to my akin to saying the grass is blue and the sky is green. And me being an ultra rational kinda dude, that's like a red rag to a bull. Anyhow, if you're still of the same opinion, then I guess we must simply agree to differ. However, I think it maybe significant that Jay himself has, conspicuously, avoided commenting on this sensitive issue.

He'd be trading illegally because if he's based in the UK then R18 content films can only legally be sold in a licensed sex shop and nowhere else.
