Well, since we don't have a written consitution, and certainly not a first amendment to it, he was only speaking about how the proposed law would have affected the States.

I think the point was that this was legislation proposed in the states - therefore it could only be challenged in the states under US law. There's nothing strange or "imperialistic" about that. The law would have affected us all simply because so many sites are registered in the states.

We should all note the fact that they indeed have a constitution, whereas we have not, so in a similar fracas, in the future with some twisted right wing nutters, we would almost certainly have lost a similar fight.
We have no written rights whatsoever, other than what judges decide from day to day.
